Thank you flutechick. I have to agree though, I thought it was only illegal to sell for a profit when copying something. That is why I didn't think it was illegal to have someone copy and send it to me for free so they were not doing anything illegal. I make copies of cd's all the time and give them to friends. I do know a ton about computers as I am a tech but how on earth are they going to find out by doing something one time. Believe me they are looking for much worse out there in computer/internet land than someone copying music sheets from a book and sending it over the internet. My goodness I didn't think me asking for some music was going to be such an argument from so many people.

On another note does anyone know where I can get a tuner for the flute so she knows if her flute is in tune before each time she practices at home.

You can get tuners at any local music store or buy them online at places such as amazon or any other site that sells music items.

If that statement is true about copying the music you own and yadda yadda, then wouldn't it be illegal for band directors to allow copying of band works and allowing students to keep the copies? I'm just wondering, not being rude in any way, but truly just wondering. It seems a little illogical for that to be "illegal".
And I agree that honesty is a good thing but it's not like this isn't done all the time and it's not like people don't go out and sell the things they copy. That would make more sense about being illegal.
Anyways, I hope you find what you are looking for chermo. I'm sorry this turned into such a big explosion. I'm pretty sure forums are meant for people to ask questions and to politely get answers but I guess that's not necessarily the case here. Sorry folks, but being rude isn't the way to go.

hmmm...
most tuners cost much more than a Hannah Montana book...just a little food for thought.

Since your pressed for money, you could just tune to a piano if you ownm one, or an online tuning site. It's harder than using a tuner, but it works.

There a software tuners, for installation on your computer, that can be downloaded for free.

I've been using the tuner on the following web page, & it works very well.

Well Flute and Bassoon, I never said I was buying it, I have the flute in for repairs too but again that is none of anyone's business how that is all being paid for but it is not by me. OMG this is just all ridiculous. If you don't want to send me the music that is fine if you have it and don't want to send it. I never knew that this would be blown out of the water by asking for some music. The flute tuner and the flute repairs are something that is something she needs to play the flute so she doesn't get upset that she doesn't sound good at home. Something I feel she needs to practice with, the music is something that would make it easier to get her to practice before she actually starts band next school year so she can be ahead of the rest of the group and since I know how to play the flute I feel I can teach her what I know for now and let her be ahead of the group next year and I just figured that it would be better to see if anyone had it that they would send to me so I didn't have to break into the food or whatever budget to buy some music for her. I am not going to go and ask you guys to send me a flute tuner for free as I am sure they cost a ton of money but I thought sending me some music over the internet or via snail mail would not be as big of a deal as it is becoming. Flute chick you are being so nice and I really appreciate it. When I wrote this thread I didn't think that it would be that big of a deal as I am on other forums (flute and non flute related) and we all ask for things and others are willing to help out. My version of copywriting crap I guess is different that what it really is, so what there was no reason to be so rude to me and tear me up about asking for something. I guess I know not to ask for anything on this forum anymore. I feel like I can't be a memeber and ask for stuff on this forum because almost everyone is rude and mean. Not one person had to reply but you all choose to reply and basically tell me I am a bad person for asking for something. I was brought up that if you want something you ask for it. I guess my parents were wrong too in they way the brought me up. I teach my kids the same thing but maybe I am wrong too about that since so many of you are being so rude, how will that look to my kids if they did come on this forum and start reading that when people ask for stuff they get trashed. I am a great parent and love my girls very much and will do anything for them.

Rogi, thanks for the link I will try it online first but I think it will be easier to have a tuner sitting in her practice room which is her bedroom and she is too young for a computer in her room.

I never said you were a bad person...ever, or even really meant to imply it. I am just trying to say my ten cents worth.
Just curious, since you play flute, shouldn't you already have a tuner of some form? Why don't you just let her use that one?
She doesn't neccesarily have to take your expensive tuner to school, but I'm sure it wouldn't be much of a problem to let her use it at home, since you'll be right next to her while she plays to teach her.

I do not have a tuner because I know how to play I don't play now. I have taught her 3 songs already in the few weeks we have been back to playing. I have not played for about 15 years but I can still play as I have been playing the flutes so I can teach her. Her music teacher was so happy my daughter had someone who knew what they were doing. Now that she is going to start practicing today after she gets out of school I need to buy a tuner. I will no longer be posting on this site or to this thread as it has gotten out of control. Flute n Bassoon, I was not implying you said I was a bad person, when I replied to you it was just the first sentence that was for you, the rest of the reply was for everyone else who has been being jerks to me. Bye to everyone and this discussion can just be ended now as I will not be back on to read or reply to anything else anyone has to say to me.

Chermo, you may be asking for something illegal, and that's the crux of it.

I do NOT know the law precisely on this, but my own understanding is that photocopying music that is copyrighted, is against the law. There are usually warnings on the newer music that we get in wind ensemble.

I know of people who want to protect their investment after buying expensive sheet music- say they just spent $50 for a flute quartet, with score and four parts. They will sometimes give a photocopy out to the four players, so the music doesn't come back ripped or covered with Kool-Aid.

I think your request is not about getting caught, but about asking someone else to do something against the law.

If we as musicians continue copying and giving away sheet music, then those talented writers will not be paid well enough to continue their work.

As for helping you and your daughter, take a look at Jen Cluff's site. There is lots of help on finding free and non-copyright music:
http://www.jennifercluff.com/cheap.htm

There's also an excellent flute fingering chart that you can get right off the internet-this is MUCH better than most of the ones you'll find in the back of beginner books:
http://www.wfg.woodwind.org/flute/

Since you play the flute, probably the most fun and inspiring thing to do would be to play flute duets with her.

The Hannah Montana books, and many other 'popular tunes'/Harry Potter/Disney type books, have been reviewed. They are usually very poor transcriptions, re-written without regard to each particular instrument and its difficulties. So you end up with something that is very hard to play (frustrating and inappropriate for a beginner)- that only an accomplished player can handle, that said accomplished player gets very little enjoyment from playing.

You might post an ad on usedflutes.com, asking people to send you any band books or flute sheet music well suited to beginners. You might get a lot of things that are appropriate and FUN for your daughter, that other folks are happy to clean out of their closets.

Someone might have a free tuner, too, but I think getting the pitch just right is going to have to wait until your daughter can actually finger and blow the right notes. You have to start small- if the 'right' pitch comes out, you don't want to discourage the kid by saying, 'Eeeew, that's 20 cents sharp!!'

I think there are lots of folks here who will be happy to help you and your daughter, from links to free music to do-it-yourself repair and maintenence advice. I think you just asked the wrong question in the first place.

Good luck to your daughter with learning the flute

I don't see a problem with what chermo asked for and if I had it I would send it to her. I am sure I will cause more of an argument but I think that if someone wants to play certain music and they can't afford it and someone was willing to send it over to that person then that would be fine. I am sure chermo wants what is best for her daughter and if it would help new kids become flute enthusiast then so be it. The flute is a beautiful sounding instrument and so it all the music written for it. Like I said if I had the music I would send it to you chermo....

it comes down to the fact that (1) its illegal to copy a large amount of sheet music if she asked for something that was not covered by copyright i would be happy to give it to her
(2) If i had it that means that i had to pay for it in the first place and if i had to pay for it why cant she no one gave it to me for free alltho i deffinatly woulden't ask someone for it theres plenty of sheet music that i would like but cant afford to just go and buy so i get a bit now and then and eventualy i will have all the music i wanted

I agree, this has just gotten way too out of hand. Chermo was just asking a question and didn't acutally ask for someone to break the law. I think people need to be a little less rude when they answer someone's post, because I have noticed people being rude on other posts as well.

Also what is up with all the negative votes on chermo's comments and on other people's comments who are trying to defend chermo? That's rude as well if you haven't noticed.

<Added>

oh, and I forgot to mention, the whole point of these forms are to answer people's questions, so someone should be able to ask a simple question without getting yelled at.

Chermo was just asking a question and didn't acutally ask for someone to break the law.

It is ambiguous what the original question was, because Chermo asked for a copy of the Hannah Montana flute book. If someone has a book they don't want anymore, and sends it to Chermo, there is NOTHING wrong with that.

If Chermo is asking for someone to photocopy the music and send it to her, that is NOT legal.

Later posts seem to clarify that Chermo is happy to have illegally photocopied Hannah Montana music from whoever else would like to break the law with him/her.

The fines are up to $30,000 if you are caught, and if it was a WILLFUL act, up to $150,000. So now, if someone finds a photocopied piece of Hannah Montana flute music in Chermo's house, and reads this forum thread, they can figure that she WAS informed that photocopying sheet music was illegal, so she willfully did it...the IP address means they can find her, and her intent.

If you are making some sort of profit from copying the music, they can fine you up to $250,000.

Here's clarification:
http://mpa.org/copyright_resource_center/copying

Is it done anyway? Yes. But that does NOT make it legal.

If you spent a lot of long, hard work actually using your musical skills to write, compose and arrange original music that got published and sold, would YOU be happy about one buyer photocopying it and sending it to everyone so they didn't have to buy it?

I'm not sure that the whole Hannah Montana flute book was written by a talented but starving musician... but there is a LOT of good music out there that is, and I think we should actually SUPPORT the efforts of folks that might compose new, and GOOD, music for us to (buy and) play.

Chermo=flutebabe, just in case no one hasn't caught on yet.

Not too hard to figure out. Flutebabe registers right after Chermo. Flutebabe wants spare key parts in other thread. Then on usedflutes.com someone under an email address with CHERMO right in it is looking for flute keys.

Now is Chermo even an adult mother who is trying to justify breaking the law? OR a kid? Hmmm.... NOTHING justifies breaking the law. Plain and simple people!
